DEMOCRACIA AMBIENTAL: O DIREITO AO MEIO AMBIENTE ECOLOGICAMETNE EQUILIBRADO

Abstract

This article proposes to research Environmental Democracy as an instrument for accessing and promoting an ecologically balanced environment. To this end, the principles of participation, intergenerational solidarity and an ecologically balanced environment will be used, in short, the right to participate in environmental decisions as a way of accessing environmental democracy. It was defined by the following research problem: Can Environmental Democracy help the political process of choices and public policies aimed at promoting the right to an ecologically balanced environment? From the central problem, the following question arises: Can the applicability of the right to information and participation help in the decision-making process on the environmental theme? Thus, taking a critical look at this issue is relevant, as the environmental issue and sustainable development are matters of extreme relevance for current and future generations. Therefore, the general objective is to investigate Environmental Democracy as an instrument for accessing and promoting an ecologically balanced environment. As for the scientific method that supported this research, the option fell on the dialectical method. Along with the decision on the method, the adoption of qualitative and bibliographic research was considered convenient. The structure of the article was organized into two topics. The first addressed environmental democracy as the right to access an ecologically balanced environment. The second dealt with the principles of environmental protection. In view of this, in the conclusion, it became evident that it is necessary to evolve and improve the legal provisions that deal with environmental protection, in particular, the right to access an ecologically balanced environment, a right for all.
