ARE THERE LIMITS TO PROTECTING TRADE SECRET

This article will initially address all aspects relating to trade secrets from its historical
evolution, the construction of its legal nature, classifications, application and protection
provided for in the legal system. And in a second moment, it will bring conceptual aspects about
the algorithm, as well as its relationship with the algorithms used by companies and which are
closely linked to the business model, being consequently understood as the trade secret of these
companies, but which manipulate data and in some cases occasions overlap with other legal
interests that also require protective measures, with the presentation of practical cases in which
the aforementioned impasse and current legislation on the subject are discussed, leading to
reflection on whether there are limits to the protection of trade secrets? The bibliographical
referential methodology was adopted in the research, using books, articles and works that deal
with the topic studied, Brazilian legislation and jurisprudence.
