A REGULAÇÃO NO BRASIL: O DESAFIO DA NOVA GOVERNANÇA

Abstract

Brazil, after the Federal Constitution of 1988, experienced a series of changes in the way the State acted. The need to make management efficient led the State to promote administrative reforms to seek a managerial bias, focused on results, with the aim of improving the provision of public services. From this perspective, the so-called regulatory agencies were created, with the mission of guiding, regulating and supervising economic activities carried out in the country, promoting the defense of the public interest, in the view of the State, as a rule. However, after a few decades of these changes, it is observed that public management alone cannot provide adequate responses to the challenges of the economic market, requiring the participation of other market actors, which is the challenge of the new governance: to establish a management polycentric.
