Abstract

In short, the objective of this paper is to deepen the studies concerning the State Inspection of concessionaires and permittees that provide Public Services. Initially, the different concepts of public services will be addressed, as well as the modalities of provision performed directly by the federative entity or in some cases indirectly by Concessionaires or permittees. Then, the forms of operation of the concessionaires and permittees will be explained, which may exercise state activity since the concession is granted through bidding, observing the specificities of the procedure provided for by law. Finally, the Inspection performed by the State of Public Services developed by the concessionaires and permissionaires will be examined, stressing that the companies contracted to carry out state activities, continue to be inspected by the State, since the granting entity does not lose the title and responsibility of the task, only ceases to be effective, and the contractor may incur the sanctions provided for by law, always safeguarding prior defense.
