DAMAGE TO THE ENVIRONMENT: A JURISPRUDENTIAL ANALYSIS ON LIABILITY OF LEGAL ENTITIES IN BRAZIL

Brazil has been experiencing several environmental disasters that not only harm human lives, but also greatly devastate the environment. Most of these accidents are caused by the action or omission of people active in economic, public and/or private activities. The performance of business organizations is directly related to these occurrences and there are several lawsuits involving the accountability of these people that result in the removal, or not, of entrepreneurs and administrators of their operations. Thus, in this article, it was about verifying the order and its applicability, in real cases, involving destruction and the institute of disregarding the legal personality of companies that commit environmental crimes. The production was guided by the hypothetical deductive method, qualitative research methodology and techniques of studies in primary and bibliographic sources of law, which allowed analysis and interpretation of the applicability, or not, of legal dictates in this very recurrent area. The study allowed to infer that significant advance were made, however, there is still a lot to be resolved, from the awareness of individuals to the commitment of entrepreneurs, companies, and business societies, also, notably, of the public power, so that, in medium and in the long term, improvements can be verified that impact the quality of life of people and other beings on this planet Earth
